History of Project
In 2010 the Ellensburg City Council recognized a need to update the City’s land development code regulations in order to:
  • correct inconsistencies within the codes and between the codes and the City’s Comprehensive Plan;
  • bring the old 1970’s codes up to date with current best planning practices and provide a more user-friendly development code;
  • implement the policy direction adopted in the City’s 2007 Comprehensive Plan Update including more development options with a clearer vision of what the desired outcome should be; and,
  • provide for future development that was more energy efficient and that improved walkability in the community..


City staff has been working with a consultant the Planning Commission, the Landmarks and Design Commission, the public, and City Council to develop a new unified development code that addresses those identified needs. Significant public participation and input opportunities have been available during development of the Final Draft Land Development Code including: a community survey; stakeholder interviews; a community openhouse/ workshop; this project webpage; town talk articles; and, numerous City Council and City Board/ Commission study sessions that were open to the public.

After several drafts of the document were reviewed, a final draft Land Development Code has been developed and is ready to go through the formal public hearing process leading to consideration of adoption.


A Planning Commission Public Hearing on the Final Draft Land Development Code was held on November 6, 2013 at 5:45 PM in City Council Chambers, 501 N. Anderson Street, Ellensburg, Washington.

PROCESS
The Planning Commission will conduct the public hearing and after the close of the public hearing will discuss and then make a formal recommendation to City Council on the final draft Land Development Code.  City Council will then hold a public hearing (tentatively to be set for November 18, 2013 at 7 PM in City Council Chambers) to recieve public comment on the final draft Land Development Code and an implementing ordinance.  After the close of the public hearing Council will then discuss and may hold first reading of the implementing ordinance at that time or at a subsequent Council meeting.  Council may direct additional changes to the document either prior to first reading or after first reading.  Once first reading has occurred the document will be amended, if directed, and will be returned to Council at a subsequent meeting for second reading and consideration of adoption.


State Environmental Policy Act (SEPA) Review and State Agency Review
An Environmental Checklist was reviewed by the SEPA Responsible Official and a Determination of Non-Significance (DNS) was issued for the Draft Land Development Code. Those documents are available at the links below or for public review at the Community Development Department, 501 N. Anderson Street, Ellensburg, WA 98926.   No appeal of that DNS was made.

The City also provided the Growth Management Act (GMA) required 60-day notice to State agencies of proposed adoption of a development regulation.  Only one comment was received and it related to the City's Critical Area Ordinance which is not being amended or changed by this Land Development Code update other than to format its numbering and make its review processes consistent with the Land Development Code.

The Responsible Official has determined that subsequent changes to the that Draft Land Development Code that City Council has requested be made in the final Draft LDC do not result in any probable significant adverse impacts on the environment and do not warrant a reconsideration of the Determination of Non-Signficance (DNS) previously issued for the revised Draft Land Development Code.  And the Director has determined that such subsequent changes do not rise to a level of significance to warrant a re-issuance of the State agency notice.


EARLIER DRAFTS
September 11, 2013  A Revised Final Draft of the Land Development Code Update dated September 11, 2013 was released for public review and comment.  The Revised Final Draft incorporates changes to the July 2013 Final Draft that City Council has directed be made in response to public comment at a series of special meetings in late July through early September.  It also corrects a number of typographical errors and formatting issues identified in that July 2013 Final Draft.

July 2013 Draft  City Council  held special meetings to take comment and provide staff with direction on the July 2013 version of the Draft Land Development Code.  Those meetings took place on July 22, July 29, August 12, and August 26, 2013.  Council completed that review at its regular meeting on September 3, 2013 and directed staff to make a number of changes to that July 2013 version.
